What you need to rent jet skis legally
In Spain, jet ski rental (jet skis are considered recreational craft) is regulated by the Directorate-General of the Merchant Marine and supervised by the Harbour Masters, on top of coastal regulations and each region's rules. As an operator you must meet requirements on four fronts: the rider's license, insurance, activity authorizations and documentation.
- Craft (jet skis) properly registered and with their inspections up to date.
- Mandatory civil-liability insurance for each craft.
- Authorization to run the activity and, depending on the area, occupation of public domain.
- Valid license or authorization for whoever operates the craft.
- Logbook and documentation for each rental.
Licensing: does the customer need one?
It depends on the craft's power and the rental format. Broadly there are three paths:
- Navigation license: allows operating limited-power jet skis after a short theory-and-practice course. The usual route for customers who want to ride on their own.
- Higher nautical qualification (PNB, PER…): for more powerful craft a higher qualification is required depending on the craft's category.
- Guided or 'baptism' format: the customer rides without a license inside a marked circuit under the direct supervision of a qualified instructor. The most common format for tourist rentals.
Company and activity requirements
Beyond the customer, the rental company must be compliant to offer the service.
- Registration of the economic activity and the corresponding tax compliance.
- Authorization for the rental activity and, if you operate from a beach or maritime-terrestrial public domain, the concession or occupation authorization.
- Craft registered in the company's name, with technical inspection in force where applicable.
- Safety and rescue means required for the activity.
- Instructors with the appropriate qualification for the guided format.
Mandatory insurance
Each jet ski must have mandatory civil-liability insurance covering damage to third parties. For your business it's also wise to have broader coverage.
- Mandatory civil liability per craft (damage to third parties).
- Own-damage coverage for the craft, with its excess.
- Coverage for the activity and instructors in the guided format.
Navigation zones and distance from shore
Jet skis can't navigate just anywhere. Their use is restricted to protect bathers and the coastline.
- Departure and return only through the channels or marked zones set up for it.
- No navigating inside bathing areas or closer than the minimum distance from shore set by local rules.
- Respect for speed and safety distances to bathers, divers and other vessels.
- Daytime navigation and within the limits of the authorization.
Mandatory documentation for each rental
Each rental generates paperwork you must be able to show in an inspection: the customer contract, the safety-briefing statement and the activity logbook.
Keeping this up to date in peak season is where most operators slip, and where it's easiest for a detail to be missing in an inspection.
Penalties for non-compliance
Breaches of navigation and maritime-safety rules can mean significant fines and, in serious cases, immobilization of the craft or loss of the authorization. Navigating out of zone, without insurance or without the proper license are among the most penalized.
