Risk acknowledgement, fitness declaration, safety rules, annexes per activity (jet ski, kayak/SUP, parasailing), guardian consent and data protection.
What a waiver does and does not do
Enforceability varies a lot. Some US states uphold recreational waivers that are clearly written, others read them narrowly, and in the EU and the UK consumer law generally does not let a business exclude liability for personal injury caused by its own negligence. What works everywhere is a clear risk acknowledgement: it shows the customer was informed, declared they were fit and accepted specific rules.
- It helps you prove that you explained the risks and the rules, and that the customer declared their health and ability.
- It records the guardian's consent when a minor takes part.
- It does not cover a failure in your own maintenance, equipment or supervision.
What the template includes
- Participant and activity details (date, time, base).
- Acknowledgement of the general risks of activities at sea.
- Health declaration: can swim, no alcohol or drugs, heart, back or neck conditions, pregnancy where the activity advises against it.
- Commitment to follow the instructor's instructions and wear a life jacket.
- Annex per activity: jet ski, kayak or paddle board, parasailing.
- Legal guardian consent for minors.
- Photo and video consent (optional, separate).
- Data protection.
What changes by activity
| Jet ski | Kayak / SUP | Parasailing | |
|---|---|---|---|
| Main risk | Collisions and falls at speed | Currents and drifting from shore | Take-off, landing and wind shifts |
| What the customer declares | They received the handling briefing and the permitted area | They can swim and will stay in the indicated area | Their weight, and no back or neck injuries |
| Worth recording | Driver and passenger separately | Unit and departure time | Flight combination (single, tandem, triple) |
How to use it, step by step
- 01Adapt the template with your details and your base's specific rules.
- 02Keep only the annexes for the activities you sell.
- 03Every participant signs their own; the guardian signs for each minor.
- 04File the waiver with the booking so you can find it if there is a claim.
With Solnow the waiver is signed on the customer's phone when they book or through the stand's QR code, and it is filed with the booking: no more folders of wet paper.
